Rule change no. 10 - retrospective consultation and assessment following rule change under urgency - timing of assessment of submissions on transmission pricing guidelines issues paperIn November 2004, an amendment was made to rule 5.3 of section IV of part F of the Electricity Governance Rules 2003 using the urgency provisions contained in s172E(3) of the Electricity Act 1992. This amendment was to provide for the possibility that the Board may require more than 20 business days to consider submissions on the transmission pricing guidelines issues paper, as required under rule 5.3 of section IV of part F.

Under s172E(3)(a) of the Act, within 6 months of a rule being made using the urgency provisions, the Commission is required to publish the statement of proposal and the assessment of costs and benefits associated with the rule made under urgency, and to consult with interested parties on the amendments, in accordance with s172E(2)(b) of the Act.

Following consultation, the Commission is also required to make a recommendation to the Minister of Energy on whether or not the rule should be revoked, replaced, or amended. The Minister must then publish a notice in the Gazette stating whether or not he decides to recommend the revocation, replacement, or amendment of the rule and explaining the reasons for that decision.

The consultation paper for rule change no.10 (including the statement of proposal and assessment detailed in the paper) has been prepared in accordance with s172E(3).

The Commission invites submissions on this paper by 5pm on 17 March 2005. Please note that submissions received after this date may not be able to be considered.
