Electricity Industry Participation Code (Clarifying Retail Tariff Plans) Amendment 2026

 

This amendment to the Electricity Industry Participation Code 2010 (Code) is made under sections 38 and 39(3)(a) of the Electricity Industry Act 2010 (Act) by the Electricity Authority having complied with section 39 of the Act.

Amendment

 

1        Title

This is the Electricity Industry Participation Code (Clarifying Retail Tariff Plans) Amendment 2026.

 

2        Commencement

          This amendment comes into force on 30 October 2026 immediately after the commencement of the Electricity Industry Participation Code (Improving Access to Product Information) Amendment 2026.

         

3        Code amended

          This amendment amends the Electricity Industry Participation Code 2010.

 

Part 1

Amendments to Part 1 of Electricity Industry Participation Code

 

4       Clause 1.1 amended (Interpretation) 

         In clause 1.1(1), definition of generally available retail tariff plan,—

(a)     in paragraph (a), insert “any” after “if the consumer satisfies”; and

(b)     in subparagraph (iii), replace “; but” with “:”; and

(c)     after subparagraph (iii), insert:

(iv)    the consumer’s electricity end-use, equipment or load characteristics; but

Amendments to Part 11 of Electricity Industry Participation Code

 

Schedule 11.6 amended

 

5       Form 1 of Schedule 11.6 amended

         Replace the second bullet pointed text at paragraph (a) with:

•    information about the retail tariff plan applicable to the consumer’s ICP, including the relevant product identification code; and

 

6       Form 2 of Schedule 11.6 amended

         Replace the second bullet pointed text at paragraph (a) with:

•    information about the retail tariff plan applicable to the consumer’s ICP, including the relevant product identification code; and

Explanatory Note

 

This note is not part of the amendment but is intended to indicate its general effect.

 

This amendment to the Electricity Industry Participation Code 2010 comes into force on 30 October 2026.

 

The amendment amends Parts 1 and 11 of the Electricity Industry Participation Code 2010 to clarify the definition of ‘generally available retail tariff plan’ and make minor corrections to two forms in Schedule 11.6 relating to the authorisation of an agent to request consumption information on behalf of a consumer.

 

 

 

 

This is secondary legislation issued under the authority of the Legislation Act 2019.
