Approval of settlement between Counties Energy and Awhitu Windfarms

On 15 December 2023 the Electricity Authority approved a settlement between Counties Energy Limited and Awhitu Windfarms Limited.
The settlement was an outcome of an investigation of Counties Energy Limited for alleged breaches of the Electricity Industry Participation Code 2010 (the Code).
Awhitu Windfarms Limited reported to the Electricity Authority that Counties Energy Limited may have breached clause 23(2) of Schedule 6.1 of the Code on 7 June 2020.
As a result of the Electricity Authority’s approval, the settlement is final and binding on all parties (subject to regulation 26 of the Electricity Industry (Enforcement) Regulations 2010).
The Electricity Authority informed the parties of its settlement decision on 21 December 2023.
