Legal information for the use of the Forecast Delivery System (API / SFTP)

These are the terms and conditions that users agree will apply when they use the Forecast Delivery System of the approved forecast provider (AFP).

These terms and conditions apply whether the delivery method is via an application programming interface (API); a Secure File Transfer Protocol (SFTP); or (should it be instituted) a web interface.

As required by the Electricity Industry Participation Code 2010 (Code), the Authority has prescribed that the current AFP is DNV Services UK Limited (DNV).

By continuing to use the Forecast Delivery System, you are deemed to have agreed to these terms and conditions

Material on the Electricity Authority website is subject to the Copyright, disclaimer and transparency statement. Additional provisions apply to the use of the Forecast Delivery System of the AFP as set out below.

Copyright

The intellectual property related to the production of the data provided via the Forecast Delivery System is protected by copyright owned by the AFP.

You are free to copy, store and adapt the data received via the Forecast Delivery System for the purposes provided for under the Code, but you may not use the materials for other purposes without the express written permission of the AFP. Should you wish to use the materials for other purposes please contact the Authority in the first instance at: forecasting@ea.govt.nz

Privacy

The AFP may collect statistical information about your use of the Forecast Delivery System. This information is aggregated and non-personally identifying. It includes:

  • your IP address;
  • site registration details eg, for your API site;
  • your usage;
  • your operating system (eg, Windows 7, Mac OS X);
  • the type of web browser you used (eg, Internet Explorer, Mozilla Firefox); and
  • other incidental matters such as screen resolution, and the language setting of your browser.

Use of statistical information: The statistical information referred to above will be viewable by AFP administrators and certain other AFP staff. It may also be shared with the Authority or other Government agencies.

Where you provide personal information (e.g., registering as a user or by completing a form), DNV and the Authority will use that information only for the purpose for which it was given.

When dealing with information the AFP complies with the relevant information legislation, such as the Official Information Act 1982 and the Privacy Act 1993.

You have the right to access and request to update and/or correct personal information (if any) that is held.

Disclaimer

The information provided via the Forecast Delivery System is to facilitate compliance with Code requirements. All reasonable measures have been taken to ensure that the data and other information it contains is accurate and that service levels will be maintained. However, users are advised that:

  • given the data relates to weather, this is, by its nature, unpredictable and subject to change;
  • data and other information provided via the Forecast Delivery System is true and accurate to the AFP’s reasonable knowledge and belief based on the information available to it, but neither the AFP (or the Authority) accept any liability for its accuracy or content;
  • the AFP may change the basis for the data released through the Forecast Delivery System without notice.
