Authority notes decision on South Pacific Energy Limited

The Electricity Authority Te Mana Hiko (Authority) acknowledges a Rulings Panel decision published today which fined electricity retailer South Pacific Energy Limited $88,000 for multiple breaches of the Electricity Industry Participation Code 2010 (the Code).

The Rulings Panel, an independent body that determines breaches of the Code, found South Pacific Energy breached the Code relating to payment and prudential security obligations during 2024 and 2025.

The Authority lodged a formal complaint with the Rulings Panel in September 2025 alleging South Pacific Energy was late with its payments to the clearing manager on several occasions for electricity purchased, and failed to provide the clearing manager with prudential security at the minimum required level in breach of clauses 14A.6(2), 14.31(1)(a) and 14.32(1) of the Code.

The Rulings Panel also awarded costs of $4,775 to the Authority.
