Proposed updates to OTC bids and offers data notice

We are seeking feedback on a proposal to amend the over-the-counter (OTC) bids and offers data notice.

The proposal is informed by analysis of data received under the current notice and feedback from market participants. It also reflects the evolving needs for monitoring level playing field measures.

The proposed amendment seeks to expand the scope of the notice by requiring information from energy brokers and include more industrial participants.

We also propose to make a few other changes to the notice which would allow us to:

  • efficiently distinguish between firming and power purchase agreement (PPA) contracts
  • effectively identify relevant information (eg, traded contracts, multiple offers, reasons for providing non-conforming offers, and reasons for declining offers)
  • increase the ease for applicable participants to submit data to the Authority by clarifying several fields in the notice
  • simplify and improve the submission process for applicable participants
  • fix technical or minor issues identified in the original notice.

The proposed changes to the clause 2.16 notice aim to improve our monitoring of competition in the OTC market, in line with our statutory functions (industry and market monitoring and market-facilitation measures).

We welcome your feedback by 5pm, 1 September 2026.
