Exemptions from Part 3 of the Act and Part 6A of the Code
Applications for exemptions about the separation of distribution from certain generation and retailing.
Overview
The Electricity Authority may grant an exemption or dispensation from obligations relating to the separation of distribution from certain generation and retailing. These obligations are found in Part 3 of the Electricity Industry Act and Part 6A of the Electricity Industry Participation Code.
All applications are assessed on an individual case by case basis by our Compliance Committee/Board. In some cases, we publish applications for a Part 3/Part 6A exemption or dispensation and consult on draft decisions on applications.

Project background
Part 3 of the Electricity Industry Act and, since 2022, Part 6A of the Electricity Industry Participation Code contains provisions that relate to the separation of distribution from certain generation and retailing. To find out if these obligations apply to you, read our Guidelines on Part 3 of the Act and Part 6A of the Code.
An industry participant can apply for an exemption, and a specified person can apply for a dispensation, from these obligations.
Note, applications pre-2022 are for Part 3 of the Electricity Industry Act. The Electricity Industry Amendment Act 2022 moved most obligations to Part 6A of the Code, although ownership separation between generation and distribution remains in Part 3 of the Act.
