Additional consultation: Improving visibility of competition in the OTC contract market

We are undertaking additional consultation on our proposed clause 2.16 information notice to improve monitoring and transparency of the over-the-counter market.

In our initial consultation we proposed requiring information from all retailers (including gentailers) and large industrials on their requests for buying contracts and responses to those requests.

Thanks to all who engaged with this consultation.

Following that feedback, we are now proposing to expand the scope of the notice in two ways:

  • collecting information from all generators (including non-integrated generators)
  • capturing sell requests.

We want to ensure parties affected by the expanded scope have the opportunity to provide feedback and we welcome additional feedback from other parties.

We will run a webinar to help participants understand the proposed notice and answer any questions during an abbreviated consultation period.

We have also made some other changes to the original clause 2.16 notice after considering submissions from the May consultation. We think it’s beneficial in this additional consultation for participants to see the proposed notice in full, including those proposed changes. The consultation is open until 5pm, Thursday 24 July.
