This notice is to remind industry participants with obligations under Part 6A of the Electricity Industry Participation Code 2010 (Code) of their upcoming reporting requirements.
Part 6A of the Code imposes rules relating to the separation of distribution from certain generation and retailing activities. Reporting requirements apply when there is a ‘connected generator’ or ‘connected retailer’ on a distributor’s network.
Directors to certify compliance with clause 6A.4
Directors of a distributor who have a connected retailer or a connected generator must provide the Electricity Authority with a certificate stating whether, in the preceding calendar year, the:
- distributor agreement terms are a true and fair view of the terms on which line function services and information were supplied in respect of the retailing or generating to which the agreement relates; and
- clause 6A.4 has been otherwise fully complied with.
Directors need to complete and return this distributor’s statement.
Directors to report compliance with arm’s length rules
No later than 31 March (each year), each director of a business to which the arm’s-length rules apply must provide a statement to the Authority confirming whether the director has complied with all of the arm’s-length rules during the previous calendar year.

Disclosure of information to the Authority under clause 6A.7
Within two months after the end of the financial year, each director of a distributor with a connected retailer or connected generator must ensure the distributor discloses to the Authority the quantity of electricity sold each financial year by connected retailers to customers who are connected to its network.
Directors need to complete and return this director’s statement.
